Understanding Cannabis Regulations: What You Need to Know Before You Light Up

As cannabis continues to become more widely accepted and legalized across the U.S., it's important to stay informed about the regulations that govern its use. While it's exciting to enjoy the freedom of legal cannabis, there are still important restrictions that must be followed to ensure compliance with state and federal laws. In this blog, we'll break down three major regulations that customers often ask about: why you can’t take cannabis out of state, why you can’t bring it on a plane, and why public consumption is still prohibited in most places.

Why Can’t I Take Cannabis Out of State?

Even if cannabis is legal in the state you’re in, taking it across state lines is a violation of federal law. Cannabis remains illegal at the federal level under the Controlled Substances Act, which means transporting it between states—even between states where cannabis is legal—constitutes drug trafficking. Crossing state lines with cannabis can lead to serious legal consequences, including fines and jail time, even if you're only carrying a small amount for personal use.

At Starbird, we see hundreds of visitors from other states travelling to our beautiful Witch City. Even if you are just traveling in state, make sure your cannabis stays in a locked container while driving, (the trunk or your glovebox) without the seal broken. Violating the open container law can result in a civil penalty up to $500. Which is money you should be spending on your herb, not tickets !

Additionally, states have different regulations surrounding cannabis possession and use. What’s legal in one state might not be in another, so it’s best to check the laws of whatever municipality you are in. Remember, cannabis purchased in one state must stay in that state.

Why Can’t I Bring Cannabis on a Plane?

Planning to take your favorite strain on vacation? Unfortunately, taking cannabis on a plane is also prohibited, whether it be flower, vapes or edibles,. This is because airports and airlines operate under federal regulations, and as mentioned earlier, cannabis remains illegal federally. This rule applies whether you’re flying within a legal cannabis state or traveling to another one.

TSA (Transportation Security Administration) agents are required to report any cannabis found during security checks to law enforcement. While TSA's focus is on security threats rather than small amounts of cannabis, they must enforce federal law, which could result in confiscation, fines, or even legal action depending on the situation. So, leave your cannabis at home when heading to the airport, and pick some up at your destination—assuming it's legal there. If you are going abroad, you’ll be in luck in Canada and Thailand! They are some of the few other countries where recreational cannabis is legal. Be aware that our staff are not able to sell you cannabis if they are under the assumption you are going to take it across state lines or to the airport.

Why Can’t I Smoke Cannabis in Public?

While many states have legalized cannabis, most still prohibit smoking or consuming it in public spaces. This includes places like parks, streets, and sidewalks. These restrictions are in place for a few key reasons:

  1. Public Health and Safety: Just like with tobacco, public cannabis use can affect others who may not want to be exposed to secondhand smoke. By limiting where people can consume cannabis, states aim to protect the rights and comfort of the general public.

  2. Legal Boundaries: Public consumption laws help reinforce the idea that cannabis, despite being legal, is still a regulated substance. By keeping consumption private, it reduces the chances of misuse or exposure to minors.

  3. Tourism and Visitors: Not everyone visiting or living in a state where cannabis is legal may be familiar with its use or comfortable around it. Restricting public use helps maintain a balance between those who want to partake and those who prefer to avoid it.

While it may seem inconvenient to have these limitations, they are designed to ensure cannabis can coexist with public interests. Violating this law can result in a fine of up to $100 .Many states, however, are beginning to allow designated consumption lounges or private venues where you can enjoy cannabis socially without breaking any laws. Until then, keep your cannabis consumption private—in your home or in a permitted space.

Stay Informed, Stay Responsible

Navigating the regulations around cannabis can be tricky, but it's crucial for staying compliant and avoiding legal issues. Remember, cannabis laws are evolving, but for now, it's important to follow the rules: don't take it across state lines, don’t bring it on a plane, and avoid consuming it in public. By respecting these laws, we help ensure the continued growth and acceptance of legal cannabis. Let's leave behind those outdated stereotypes about stoners and show the world how much fun and positivity we bring to the table!
